Advertising Standards Council of India (ASCI) again gives a warning to both influencers and brands about the norms of disclosing advertising spend on social platforms that have otherwise witnessed a massive increase in cases of misleading ads and endorsements by influencers and brands in domains such as finance, health, and education among others.

The recent advisory by the ASCI outlines the fact that the influencer marketing industry cannot any longer linger in a grey area. Influencer marketers have been told that any form of content, whether it involves payment or free products and services, as well as affiliate and brand collaborations, needs to be labeled with terms like #Ad or other platform-specific methods to easily distinguish it as a form of advert or marketing.

As stated by ASCI, some influencers are still exploiting the disclosure guidelines using ambiguous hashtags, putting the disclaimer at the bottom of the description, or even sneaking it in between various hashtags. The ASCI states that doing so undermines the purpose of a disclaimer.

In addition, the warning has emphasized the duty that belongs to the brands themselves. The ASCI has reminded the concerned advertisers that they are equally liable for the compliance. For instance, if the social media influencer does not follow the laid-down rules by mentioning that they were involved in a commercial partnership, the corresponding company will also find itself in the same dilemma.

The issue is also a concern, especially in high-risk advertising categories. In the financial sector, for instance, advertising influencers who advertise trade platforms, crypto, and other financial proposals with poor disclaimers are a concern to the regulatory bodies. Likewise, in the healthcare and wellness industry, advertising of supplements, skin treatments, and other health products using misleading promises may have severe repercussions for consumers. However, ASCI has made it clear that advertising with disclaimers does not condone misrepresentation.

Another significant point in this advisory has to do with video. The recent popularity of Instagram Reels, YouTube Shorts, and live stream promotional campaigns led to promotional messages conveyed in quick succession and in an informal tone. ASCI has made it clear that disclosure needs to be plain in sight, readable, and presented for long enough to be acknowledged.

Industry insiders consider the latest.warning that the influencer marketing industry is maturing in the Indian market. What was once an unofficial marketing platform is now being dealt with at the same level of importance as the offline advertising sector. Influencer marketing is no longer above criticism despite its personal or organic characteristics.

The clear imperative for influencers: Disclosure is no longer voluntary. Influencers who fail to comply with disclosure requirements can face their content being removed, loss of partnership deals with brands, as well as loss of reputation in the long run. Influencers are seeking legal advice on how to follow disclosure requirements by going back to their previous posts.

Brands, on the other hand, are tightening up their contracts with the help of “disclosure clauses” and approval “checkpoints.” Some firms are also training their social media influencers on the said issues before the campaigns roll out on the web, with others lessening the number of “risky” influencers they use.

ASCI has also urged active participation by consumers to report deceptive influencer advertisements. The level of awareness among the population has already caused a rise in monitoring influencer content, as people demand integrity and accountability from those that influence them. The growing concept of influencer marketing in India makes it imperative that ASCI’s warning is a strong indication that influence must come with responsibility. The need to remain-transparent,-authentic, and ethical has shifted from a best practice to a regulatory norm. The time is going to come when influencer marketing belongs to those who prize consumer trust over space.
